For example, could the #MeToo movement have developed in such a short period of time, and with the same reach among audiences, without social media?In addition to teaching the concept of consent, educators should consider teaching media literacy to young people.Supporting extracurricular activities, such as the <a href="https://www.couragetoact.ca/blog/high-school-too-needs-you" target="_blank" class="editor-link">High School Too</a> campaign, could help reinforce consent education taught in school.We can also encourage the adoption of tools to combat and counter the ill effects of social media (and the perpetuation of rape myths in culture more generally).Back to the Basics: Education Is About More Than Academics.When we send our children to school, we must remember it is not just so they can be taught academics. Ontario is set to introduce a new auto insurance system in 2026 that will allow drivers more flexibility in selecting their coverage. Starting on July 1, 2026, the only automatically included benefits will be for medical, rehabilitation and attendant care. All other benefits, which were previously mandatory, will become optional, enabling drivers to customize their policies based on their individual needs and preferences.This shift aims to move away from the traditional "one-size-fits-all" approach, giving drivers the ability to choose what additional coverages they want, such as Income Replacement, Non-Earner, Caregiver and House Keeping benefits. Abusers also look for situations where their targets are particularly vulnerable. For instance, a child financially dependent on an abuser may fear losing stability if they report the abuse.Children at sleepaway camps are in a uniquely vulnerable position. They might be homesick and scared, with limited access to contact their parents or guardians. They may not have formed close friendships at camp, leaving them without trusted individuals to confide in. Additionally, they might be dependent on a camp counselor who could also be their abuser and may even share a cabin with them.Campers from marginalized groups face added risks. These groups include:• People with disabilities• Girls or those with unconventional gender expressions• Racialized and Indigenous people• LGBTQIA2S+ individuals• Those from disadvantaged socio-economic backgroundsAbusers may see these vulnerabilities as reducing their risk of being held accountable. Consequently, according to research and reported incidents, thousands of sexual abuse cases have likely occurred at camps across North America over the decades.How Do Camps Mitigate the Risk of Abuse?As survivors come forward, public awareness of the risks faced by vulnerable groups at camps has grown. Survivor-led lawsuits against negligent institutions have pushed these organizations to adopt risk management practices. Some strategies include:• Implementing codes of conduct for campers and staff• Screening staff and volunteers, including police checks• Mandatory and ongoing education and training for staff• Visibility and supervisory guidelines to prevent unsupervised situations• Protocols for reporting and responding to abuse• Collaboration with external abuse prevention and response organizations• Regular safety audits• Creating a trauma-informed environment• Open discussions about inappropriate touch with campers and staffHowever, these strategies require diligent implementation and follow-through. Because there is no will, there is also no Estate Trustee who can immediately deal with your property. An application needs to be made to appoint an Estate Trustee Without a Will. The probate process is lengthier, costly and under Ontario’s Succession Law Reform Act, your estate is disposed of using this statutory distribution. According to this statutory guideline, your estate goes to your spouse and children, however if you have no children, your next of kin is your parents. If your parents are no longer living, it is passed down to your siblings, and if they are no longer living, it goes to your nieces and nephews, and so forth. Eventually if you have no living next of kin, the property escheats to the Crown and your estate goes to the Ontario government. This priority is created based on the Table of Consanguinity, which looks at each level of kinship in your family tree. However, if you are unmarried and in a common law relationship, there is no statutory right for a common law partner to inherit from your estate. This can cause you to disinherit your common law spouse without intending to do so. Additionally, if you have minor children and do not have a Will that appoints a guardian, the court will decide who to appoint without your input. It is important that a decision as significant as who cares for your children in your absence, is made carefully by yourself. Chronic Pain and Sufficiency of ProofCase Study of Grewal v. Echelon General Insurance Company1The applicant, JG, was involved in a MVA on October 1, 2020 and sought accident benefits. The respondent insurer, Echelon, paid med-rehab benefits up to the $3,500 Minor Injury Guideline (“MIG”) limit but denied further benefits, taking the position that JG’s injuries were minor. JG applied to the License Appeal Tribunal (“LAT”) for resolution of the dispute.The issues in this LAT proceeding were (a) whether JG’s injuries were minor and (b) whether JG was entitled to any of the disputed med-rehab benefits (for four physiotherapy treatment plans, one orthopedic assessment and one in-home assessment).Soon after the accident, JG returned to normal work duties and was able to perform his regular daily activities. In approximately two and a half years since the accident, although he saw his family physician, Dr. BN, 16 times, the accident was only mentioned in three appointments. He reported complaints of pain to Dr. BN a couple of times. Dr. BN prescribed him a pain reliever and recommended massage, heat, exercise, a firm mattress and soft pillow and to attend a followup appointment within a week if symptoms did not improve, but JG never went to a follow-up appointment. Dr. BN diagnosed him with lumbar strain and cervical strain as well as muscle tenderness (minor injuries), but never with chronic pain. Dr. BN never undertook further investigation, such as referring JG to a neurologist or for diagnostic imaging. JG’s OCF-3 Disability Certificate, completed by a chiropractor, also gave as diagnoses strain and sprain. An IE report by Dr. W – written after an in-person assessment and thorough medical records review – diagnosed JG with cervical strain, thoracic strain, lumbar strain and low leg strain injuries.An insured person who sustains impairments from a MVA that are predominantly minor injuries is currently limited to a maximum of $3,500 in med-rehab benefits.2 A “minor injury” is defined as a one or more of a sprain, strain, whiplash associated disorder, contusion, abrasion, laceration or subluxation and includes any clinically associated sequelae to such an injury.3If it can be proven that the insured person’s injury falls outside the definition of a minor injury, they can be removed from the MIG limit. However, the burden of proof lies with the applicant. This means that, if an applicant is seeking this exemption, the onus is on the applicant to file evidence demonstrating on a balance of probabilities that their MVA-caused injury is non-minor. <iframe data-lexical-youtube="XvhxRCNZkn0" width="560" height="315" src="https://www.youtube-nocookie.com/embed/XvhxRCNZkn0" frameborder="0" allow="accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture" allowfullscreen="true" title="YouTube video"></iframe> Two types of conditions have been held by the LAT to be injuries outside of the MIG include:a) Chronic pain with a functional impairment andb) A psychological impairment.Chronic pain is not the same thing as ongoing or recurrent pain. The American Medical Association’s Guides to the Evaluation of Permanent Impairment, 6th ed. 2008 lists six criteria as “major” characteristics of chronic pain syndrome, with three required to establish chronic pain syndrome, and the Tribunal has adopted the use of the AMA Guides as an interpretive tool for evaluating chronic pain claims:<ol class="list-ol"><li value="1" class="listitem">the use of prescription drugs beyond the recommended duration and/or abuse of or dependence on prescription drugs or other substances;</li><li value="2" class="listitem">excessive dependence on health care providers, spouse or family;</li><li value="3" class="listitem">secondary physical deconditioning due to disuse and/or fear-avoidance of physical activity due to pain;</li><li value="4" class="listitem">withdrawal from social milieu, including work, recreation or other social contracts; v. a failure to restore pre-injury function after a period of disability, such that the physical capacity is insufficient to pursue work, family or recreational needs; and</li><li value="5" class="listitem">the development of psychosocial sequelae after the initial incident, including anxiety, fear avoidance, depression or nonorganic illness behaviors.4</li></ol>One of JG’s legal positions was that he suffered from chronic pain with a functional impairment, and that it is not captured by the definition of “minor injury”, and that therefore he qualified for med-rehab benefits beyond the $3,500 MIG limit.The respondent, Echelon’s, legal position was that JG suffered a soft-tissue sprain or strain from the MVA, that sprain and strain are both clearly listed under the “minor injury” definition, and that therefore he does not qualify for treatment beyond the MIG.The LAT Member hearing this case decided that the applicant had not discharged his onus of proving that his injuries were nonminor; consequently, he was not entitled to med-rehab benefits beyond $3,500 and thus to any of the disputed benefits (since the limit had already been exhausted). Reasons included the following.<ol class="list-ol"><li value="1" class="listitem">JG’s use of a prescription drug for his pain symptoms was not significant.</li><li value="2" class="listitem">According to the evidence, JG was not excessively dependent on healthcare providers, his spouse or his family; on the contrary, he reported to his family doctor that he was fit for work, doing ok, sleeping ok and experiencing no difficulty walking.</li><li value="3" class="listitem">There was no evidence of secondary physical deconditioning or avoidance of physical activity due to pain; on the contrary, he returned to normal work duties and was able to perform his regular daily activities (and reported such to Dr. BN).</li><li value="4" class="listitem">There was little evidence of JG’s recreation or social contacts, but the LAT Member placed significant weight on his reports to Dr. BN that he was working and not functionally impaired post-accident.</li><li value="5" class="listitem">Notwithstanding there were a few pain complaints, there was no evidence of a period of disability.</li><li value="6" class="listitem">There was not enough evidence to support the applicant’s argument that he developed psychosocial sequelae after the accident; there was only one notation of anxiety in Dr. BN’s CNRs.</li></ol>In conclusion, when comparing the medical evidence in the case with the six criteria in the AMA Guides, JG did not satisfy any of the criteria of chronic pain; and, since chronic pain is only indicated by the presence of at least three of the criteria, the LAT Member concluded he did not suffer from chronic pain.In addition, the LAT Member noted that no medical practitioner diagnosed the applicant with chronic pain and that the CNRs did not mention chronic pain.In this case, the applicant’s chronic pain argument failed because there was insufficient evidence to support it.This case gives cues to what can amount to gaps in one’s chronic pain argument, such as the lack of a diagnosis of chronic pain syndrome by a qualified medical practitioner (i.e., a pain specialist) and insufficient medical records of reports of pain over time.

Ontario Land Transfer Tax The Land Transfer Tax (LTT) in Ontario is a tax paid on every conveyance of land tendered for registration as well as every unregistered disposition of a beneficial interest in land, unless specifically exempt under the applicable legislation. The amount of the LTT payable depends on the value of the consideration as defined in subsection 1(1) of the Land Transfer Tax Act (Ontario). The definition of the value of consideration is broader than simply the purchase price set out in an agreement of purchase and sale and can include, but is not limited to, items such as any liabilities assumed, any benefits conferred, and the cost of upgrades or extras. LTT is a marginal tax rate and each portion of the value of consideration is taxed at a unique rate based on the total value of consideration. The LTT is structured as follows: 1. For properties up to $55,000.00: 0.5% of the value of consideration.2. Between $55,000.01 and $250,000.00: 1.0% of the value of consideration.3. Between $250,000.01 and $400,000.00: 1.5% of the value of consideration.4. Between $400,000.01 and $2,000,000.00: 2.0% of the value of consideration.5. Over $2,000,000.00: 2.5% of the value of consideration, where the land contains one or two single-family residences. City of Toronto Land Transfer Tax If you are acquiring property in Toronto, an additional Toronto Municipal Land Transfer Tax (MLTT) is applied, in addition to the Ontario LTT. Essentially, you would pay both the Ontario LTT and the Toronto MLTT when acquiring a property located in Toronto. Directors in particular have a fiduciary duty to ensure that the corporation complies with statutory requirements, including the maintenance of corporate records. Allowing the Minute Book to fall into disuse may be regarded as a failure of governance and, in serious cases, may undermine the validity of certain corporate acts or expose the corporation to unnecessary risk.In recent years, changes to corporate transparency rules have introduced additional requirements that corporations must be aware of. Notably, under amendments to the CBCA that came into force on June 13, 2019, all federally incorporated companies are required to maintain a Register of Individuals with Significant Control (commonly referred to as an ISC Register). This register must identify any individual who owns, controls, or directs 25 percent or more of the corporation’s shares, whether directly or indirectly, or who has the ability to exert significant influence over the corporation. The register must contain information such as the individual’s name, address, date of birth, jurisdiction of tax residence, the manner in which control is held, and the date when such control was acquired or ceased. This register must be updated at least annually, and within 15 days of the corporation becoming aware of any change. Non-compliance is an offence under the CBCA and may lead to penalties for both the corporation and its officers and directors.While Ontario corporations are not currently subject to the same ISC Register requirement under the OBCA, the Ontario government has signalled its intent to adopt similar rules. As such, it is strongly advisable for Ontario corporations to begin tracking ownership information in a manner that would comply with federal standards, especially in cases where ownership is held through other corporations or trustees.Another important but often overlooked area concerns the ownership of real estate. In Ontario, the OBCA expressly requires that corporations include a real property register in their Minute Book, detailing each parcel of real estate owned, its legal description, registry information, municipal address, acquisition and disposition dates, and supporting documentation such as deeds or transfers. Federally incorporated companies are also expected, based on statutory obligations to retain a register of land interests and guidance from Corporations Canada, to maintain similar records.In practical terms, the consequences of failing to maintain a Minute Book can be significant. Corporations that are unable to produce a current and complete Minute Book may face delays in closing transactions, difficulties proving ownership or governance authority, tax complications, and in some cases, legal exposure due to missing or improperly recorded decisions. Attempting to reconstruct a Minute Book years after the fact can be both costly and time-consuming, and in many cases, it may not be possible to fully recover or verify the corporation’s legal history.The obligation to maintain a Minute Book is not limited to larger corporations or public companies. Even closely held private corporations with a single shareholder must comply with these legal requirements. The law does not distinguish based on the size or complexity of the business. Every corporation, whether provincially or federally incorporated, is subject to the same statutory obligations.If your corporation has undergone changes such as a new shareholder, change in officers or directors, issuance of new shares, change of registered address, or acquisition of real estate, these matters must be properly documented in the Minute Book. When a survivor knows and trusts (or should be expected to trust) a perpetrator, a breach can compound what is already a traumatic experience.Teachers and school staff are supposed to be trustworthy individuals. We ask them to act "in loco parentis" (in place of parents) for a significant portion of our children's waking hours, and understand that their work is to shape young minds - not only in terms of academics, but also by instilling values that support societal goals.Most teachers understand the imbalance of power they have over students and conduct themselves ethically, and with integrity and <a href="https://www.oct.ca/resources/advisories/professional-boundaries?sc_lang=en&amp;" target="_blank" class="editor-link">professionalism</a>. Some, unfortunately, do not.Sexual Abuse in Schools: By the Numbers.In a <a href="https://protectchildren.ca/en/resources-research/school-report/" target="_blank" class="editor-link">2022 study</a>, the Canadian Centre for Child Protection (C3P) examined five year's worth of disciplinary records, media sources, and criminal case law.It found 252 current or former school personnel in Canadian schools (kindergarten to Grade 12) that "committed or were accused of committing offences of a sexual nature against a minimum of 548 children between 2017 and 2021 inclusively." The study also identified an additional 38 current or former school personnel who were criminally charged for stand-alone child pornography-related offences. Private or Alternative FinancingIf traditional lenders are no longer an option, you want to may consider:Private lenders,Using a guarantor or co-signer.It is important to note that these options usually come with higher interest rates, increased legal work, and increased lending fees, but they may help to bridge the financial gap in order to close the transaction.4. Requesting a Price Abatement Due to Low AppraisalIf your mortgage financing is denied or reduced because the property has been appraised for less than the original purchase price, you may want to request a price abatement from the builder. This is a reduction in the purchase price to align with the appraised value.While builders are not legally obligated to agree, some may accept a reduction to preserve the transaction and avoid resale delays or further litigation. Once again builder’s are not obligated to provide a mutual release, however, depending on market conditions, the builder may agree to refund part or all of your deposit and release you from further obligations. This should always be negotiated through legal counsel.6. Builder Take-Back MortgageSome builders offer vendor take-back (VTB) mortgages—where the builder acts as the lender for part of the purchase price. These can be useful where you qualify for partial financing and need help bridging the shortfall.7. Reviewing the Tarion Addendum for Termination RightsAll new-build freehold and condominium purchases in Ontario include a Tarion Addendum, which outlines certain procedures for providing notice of delays in closing as well as termination rights:For residential condominiums, purchaser’s have a 10-day rescission period (following the date your APS is signed and all condominium disclosure documents were provided to you by the builder), which allows you to cancel the agreement and recover your deposit. The purpose of the 10-day rescission period is provide you with ample time to review your APS and condominium disclosure documents in detail and make an informed decision about whether to proceed with the purchase transaction or terminate the transaction.In certain cases, such as significant construction delays beyond the “Outside Closing Date” (as such term is defined in the Tarion Addendum), the addendum may permit you to terminate the agreement and receive a full refund with interest.8.
